Buying off-plan in Spain - the protections exist but you need to know what they are
Off-plan property purchases remain popular on the Costa del Sol. New developments across Estepona, Marbella, and the surrounding area attract significant expat buyer interest. The combination of customisation options, modern specification, and the potential for price growth between purchase and completion makes off-plan an attractive proposition for many buyers.
The protections available to off-plan buyers in Spain are meaningful - provided you know what they are, ensure your contract reflects them, and take the legal steps necessary to enforce them if problems arise.
Stage payment protection - the most important protection for off-plan buyers
The most significant risk in off-plan purchase is losing your stage payments if the developer becomes insolvent before completion. Spanish law requires developers selling off-plan to guarantee all stage payments made by buyers through either a bank guarantee (aval bancario) or an insurance policy (seguro de aval).
This guarantee means that if the developer fails to complete or goes insolvent, buyers can recover their stage payments. However, the guarantee is only effective if it is actually in place before you make any payment, it covers the full amount of each payment as it is made, and it is maintained throughout the construction period.
Your Spanish lawyer must verify the bank guarantee or insurance policy before advising you to make any stage payment. This is non-negotiable and is the single most important due diligence step in any off-plan purchase.
Building guarantees under the LOE
Once construction is complete and you take ownership, the Ley de Ordenacion de la Edificacion (LOE) provides three tiers of structural and defect guarantee:
- One year guarantee - the developer is liable for defects in finishing elements including floor tiles, paintwork, and fitted elements. Report any finishing defects in writing as soon as they are discovered and before the one-year anniversary of the completion certificate.
- Three year guarantee - the developer is liable for defects that affect the habitability of the property. This covers problems with insulation, waterproofing, plumbing installations, and anything that affects the property function as a comfortable home.
- Ten year guarantee - the developer and the architect are liable for structural defects including problems with foundations, load-bearing walls, and any defect that compromises the structural integrity of the building.
These guarantee periods run from the date of the certificado final de obra. Document this date carefully and diarise the expiry of each guarantee period.
What to do if defects appear after completion
- Report defects to the developer in writing as soon as they are discovered with photographs and a description of each defect
- Give the developer a reasonable opportunity to inspect and repair the defects
- If the developer fails to respond or refuses to repair, seek legal advice promptly
- For structural defects, commission an independent report from a registered architect before engaging with the developer
